Terms and Conditions of Billsboro Winery Wine Club

- Enrollment in our Wine Club is a one-year commitment. You will receive three shipments each year. The membership will continue thereafter until such time that either party notifies the other in writing of termination.

- Members will be notified at least 2 weeks in advance of the date the credit card on file will be billed. Please be sure to add catherine@billsborowinery.com to your address book and mark emails as “Not Spam."

- The wines in our club shipments are personally selected by Vinny Aliperti, our winemaker and co-owner and the Billsboro Winery team.  Members at the Rotondo and Corposo levels are eligible to choose their own allotment of wines for each shipment.  If you do not make changes to your cart in the allotted time, you will receive the winemaker selected wines.

- Substitutions or hand-selecting of club shipments at the Sapore level are not permitted.

- Members may purchase additional wines with their club discount at their convenience.

- Membership in Billsboro Winery’s Wine Club is only available to members and their immediate family.   You agree to use the Wine Club services for personal use and not for commercial purposes. We are not liable for any damages or losses caused by someone using your account without your permission. However, if Billsboro Winery suffers any damage due to the unauthorized use of your account, you may be liable. By using the Wine Club services, you represent that you qualify to use the services.

- Billsboro Winery is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Wine Club services which Billsboro Winery provides may change from time to time without prior notice to you.

- You acknowledge and agree that Billsboro Winery may stop (permanently or temporarily) providing any or all of its Wine Club services (or any features within the services) to you or to users generally at Billsboro Winery’s sole discretion, without prior notice to you. 

Pick Up Customers

- All alcohol must be picked up by someone 21 years of age or older. To receive your club pack, you may be asked to present a valid driver’s license. If you’ve arranged for someone pick up a club pack on your behalf, the Wine Club Manager must be notified 24 hours before picking up.

- Club members will receive electronic reminders to pick up their club packs. Club packs are to be picked up within 30 days of club release dates unless an extended hold is requested and confirmed in order to ensure availability of wine selections.

- To extend your hold date, please contact our Wine Club Manager at catherine@billsborowinery.com.

- In the event that club shipments are not picked up by the final date indicated on your electronic notification without request for pack to be put on hold, Billsboro Winery will attempt to contact you for pickup but if unable, we reserve the right to ship to the address on file and shipping charges will be billed to your credit card.

Shipping Customers

- All alcohol deliveries must be signed for by someone 21 years of age or older. Business addresses are recommended.

- Club members are expected to update any address shipping changes or special requests for shipment date changes through their Billsboro Winery Account on our website at www.billsborowinery.com prior to all club shipments.

- Members are financially responsible for all failed delivery attempts (signature requirement or incorrect address) unless the carrier is liable due to negligence. If your order is undeliverable and is returned to us, we will process the return and refund your card, minus any incurred shipping charges, and charge a $15 return shipping fee.  

- You will receive a tracking number for all wine shipments as well as the expected delivery date. Shipment times will depend on your location.

- All shipments will be shipped using UPS Ground.  UPS will attempt two deliveries before returning the shipment to the winery at which point, the member is responsible for any incurred additional shipping fees.  

Termination of Club Membership

 Early Inactivation

- If a club member requests to inactivate before receiving the minimum number of club shipments (3), Billsboro Winery reserves the right to bill the member a $50 early cancel fee will be charged as well as the balance of all discounts received as a benefit of club membership.

 EXCLUSION OF WARRANTIES

NOTHING IN THESE TERMS SHALL EXCLUDE BILLSBORO WINERY’S WINE CLUBS WARRANTY OR LIABILITY FOR LOSSES/, WHICH MAY NOT BE LAWFULLY EXCLUDED OR LIMITED BY APPLICABLE LAW. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES OR CONDITIONS OR THE LIMITATION OR EXCLUSION OF LIABILITY FOR LOSS OR DAMAGE CAUSED BY NEGLIGENCE, BREACH OF CONTRACT OR BREACH OF IMPLIED TERMS, OR INCIDENTAL OR CONSEQUENTIAL DAMAGES. ACCORDINGLY, ONLY THE LIMITATIONS WHICH ARE LAWFUL IN YOUR JURISDICTION WILL APPLY TO YOU AND OUR LIABILITY WILL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

YOU EXPRESSLY UNDERSTAND AND AGREE THAT YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK AND THAT THE SERVICES ARE PROVIDED "AS IS" AND “AS AVAILABLE.”

IN PARTICULAR, BILLSBORO WINERY’S WINE CLUB, ITS SUBSIDIARIES AND AFFILIATES, AND ITS LICENSORS DO NOT REPRESENT OR WARRANT TO YOU THAT:

(A) YOUR USE OF THE SERVICES WILL MEET YOUR REQUIREMENTS,

(B) YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE OR FREE FROM ERROR.

ANY PRODUCTS OBTAINED THROUGH THE USE OF THE SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND THAT YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE THAT RESULTS FROM YOUR USE OF THE SERVICES AND PRODUCTS.

BILLSBORO WINERY’S WINE CLUB FURTHER EXPRESSLY DISCLAIMS ALL WARRANTIES AND CONDITIONS OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO THE IMPLIED WARRANTIES AND CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT.

SUBJECT TO OVERALL PROVISION IN THE PARAGRAPH ABOVE, YOU EXPRESSLY UNDERSTAND AND AGREE THAT BILLSBORO WINERY’S WINE CLUB, ITS SUBSIDIARIES, AND AFFILIATES, AND ITS LICENSORS SHALL NOT BE LIABLE TO YOU FOR:

(A) ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES WHICH MAY BE INCURRED BY YOU, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY.

(B) ANY LOSS OR DAMAGE WHICH MAY BE INCURRED BY YOU, INCLUDING BUT NOT LIMITED TO LOSS OR DAMAGE AS A RESULT OF:

(I) ANY RELIANCE PLACED BY YOU ON THE COMPLETENESS, ACCURACY OR EXISTENCE OF ANY CONTENT;

(II) ANY CHANGES WHICH BILLSBORO WINERY’S WINE CLUB MAY MAKE TO THE SERVICES, OR FOR ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE SERVICES (OR ANY FEATURES WITHIN THE SERVICES);

(III) YOUR FAILURE TO PROVIDE BILLSBORO WINERY’S WINE CLUB WITH ACCURATE ACCOUNT INFORMATION;

(IV) YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL;

THE LIMITATIONS ON BILLSBORO WINERY’S WINE CLUB LIABILITY TO YOU ABOVE SHALL APPLY WHETHER OR NOT BILLSBORO WINERY’S WINE CLUB HAS BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.

It is Billsboro Winery’s Wine Club policy to respond to notices of alleged copyright infringement that comply with the applicable international intellectual property law (including, in the United States, the Digital Millennium Copyright Act) and to terminating the accounts of repeat infringers.

By submitting, posting or displaying any content on or through Billsboro Winery’s website or social media, you give Billsboro Winery’s Wine Club a perpetual, irrevocable, worldwide, royalty-free, and non-exclusive license to reproduce modify, translate, publish, publicly perform, publicly display and distribute any content which you submit, post or display on or through. Billsboro Winery’s Wine Club reserves the right at any time to remove any content generated, submitted, posted or displayed by you. You confirm and warrant to Billsboro Winery’s Wine Club that you have all the rights, power and authority necessary to grant the above license.

Billsboro Winery uses direct to consumer shipping permits and ships in accordance with direct shipping laws for sales in NY and PA. ALL ALCOHOLIC BEVERAGES PURCHASED FROM BILLSBORO WINERY’S WINE CLUB ARE SOLD IN THE STATE OF NEW YORK AND PENNSYLVANIA AND THE TITLE PASSES TO THE BUYER IN THOSE STATES. Billsboro Winery’s Wine Club makes no representation to the legal rights of anyone to ship or import alcoholic beverages into any state outside of New York and Pennsylvania. The buyer is solely responsible for the shipment of alcoholic beverage products. By placing an order, buyer authorizes Billsboro Winery to act on buyer’s behalf to engage a common carrier to deliver buyer’s order. All credit card payments will be facilitated by Billsboro Winery .  Due to state laws, wine can be purchased only by adults 21 years and older. Drinking wine may increase the risk of cancer, and, during pregnancy, can cause birth defects.
